A testamentary trust can provide for their care and well-being, outlining how and when they receive funds, while safeguarding those assets from potential misuse.
Moreover, a testamentary trust allows you to appoint a trustee, someone trustworthy who will manage the assets according to your instructions. This ensures your loved ones are taken care of responsibly, even if they lack the financial experience or judgment to handle large sums of money.

Steve, are there any common issues or challenges people might encounter with testamentary trusts?
While testamentary trusts are generally effective tools, one potential challenge is that they go through probate. This means the court oversees the distribution of assets according to your will, which can be a time-consuming process.
I recall a case where a family disagreed on how to distribute assets left in a testamentary trust. The disagreement prolonged the probate process significantly and resulted in added legal fees. Consequently, open communication among family members about estate plans is crucial.
