Steve, could you walk our viewers through one of the key steps in the estate planning process?

Certainly. One crucial step is marshalling the estate assets. This involves meticulously identifying and inventorying all of the deceased person’s possessions.

Consequently, this includes everything from bank accounts and real estate to vehicles, personal belongings, and even digital assets. We then formally document these assets in an Inventory and Appraisal (Forms DE-160/161), which is filed with the court for approval.

This step can be complex, as it often requires tracing down forgotten accounts or deciphering ownership of assets acquired over a lifetime. Moreover, accurately valuing these assets, especially items like art or collectibles, may necessitate professional appraisals.

Notwithstanding the complexities, marshalling the estate is essential for ensuring that all assets are accounted for and distributed according to the will’s instructions or state intestacy laws if there is no will.

Challenges in Estate Marshalling

Have you encountered any unique challenges during this step?

There was one instance where we were tasked with locating a hidden savings account for a client who had passed away unexpectedly. He’d kept meticulous records, but the account information was buried in a box of old documents.

After days of sifting through paperwork, we finally uncovered the details. The account held a substantial sum, which ultimately provided much-needed financial security for his heirs.

The Importance of Accurate Documentation

That’s a great example of how diligence pays off. Are there any statistics that highlight the significance of accurately documenting assets?

According to a recent study by the National Endowment for Financial Education, over 60% of Americans do not have a written inventory of their assets. This lack of organization can create significant delays and confusion during probate, potentially leading to disputes among heirs.
