Today we have the pleasure of speaking with Ted Cook, an elder protection attorney serving the San Diego area. Ted, thanks for taking the time to chat with me.
What Inspired You To Focus On Elder Protection Law?
Well, it’s a deeply personal field for me. I witnessed firsthand the vulnerabilities seniors face, especially when it comes to financial exploitation and abuse. Seeing loved ones taken advantage of ignited a passion in me to protect those who are often overlooked.
Could You Walk Us Through The Steps Involved In Elder Protection?
It’s a multifaceted process designed to safeguard seniors from harm. We start with initial client engagement, where we listen carefully to their concerns and gather all the necessary information. From there, we assess the legal issues involved, collect evidence, and evaluate the risks they face.

- Case Resolution & Follow-Up
Let’s Dive Deeper Into “Protective Actions.” Can You Elaborate on What That Entails?
“Protective actions” are often the most critical stage. They involve swift and decisive measures to ensure our clients’ safety and well-being. This could range from filing restraining orders against abusers to freezing financial accounts that may be at risk.
Sometimes, we need to petition for guardianship or conservatorship if a client is unable to make sound decisions due to diminished capacity. We also work closely with Adult Protective Services (APS) and other agencies to provide comprehensive support.
“Ted was incredibly empathetic and understanding during a difficult time for my family. He helped us navigate a complex situation involving elder abuse and secured the necessary protection for my mother. I can’t thank him enough.” – Mary S., La Jolla
“Point Loma Estate Planning APC went above and beyond to protect my father’s assets from exploitation. They were thorough, professional, and truly cared about our well-being.” – John T., Point Loma
Have You Encountered Any Specific Challenges While Implementing Protective Actions?
One memorable case involved a client who was being financially manipulated by their own caregiver. The caregiver had gained the client’s trust and was systematically draining their bank accounts. Identifying this abuse required meticulous review of financial records and uncovering subtle patterns of coercion. Thankfully, we were able to intervene in time and protect the client’s remaining assets.
Another challenge arises when clients are reluctant to acknowledge they’re being abused. Sometimes, fear, shame, or cognitive impairment can prevent them from seeking help. In these situations, building trust and approaching the issue with sensitivity is crucial.
