Estate planning often involves using legal tools like trusts to reduce or eliminate estate taxes. This is particularly important for individuals with significant assets. Consequently, careful planning can save your heirs a substantial amount of money.

For example, according to the Tax Policy Center, in 2023, the federal estate tax exemption is $12.92 million per individual. This means that only estates exceeding this threshold are subject to federal estate taxes. Nevertheless, even if your estate doesn’t reach the federal exemption, state estate taxes may still apply.

That’s valuable information. Today we want to focus on one specific aspect of estate planning: selecting an executor or trustee. Why is this step so crucial?

Choosing the right person to manage your estate after you’re gone is paramount. This individual, known as the executor for a will or trustee for a trust, will be responsible for carrying out your wishes and distributing your assets according to your plan.

It’s essential to select someone trustworthy, organized, and capable of handling financial matters. Ordinarily, people choose a close family member or friend. However, it’s also wise to consider professional fiduciaries if you have complex assets or anticipate potential conflicts among beneficiaries.

I recall one instance where a client named his son as executor, but unfortunately, the son was going through a difficult personal time and struggled with the responsibilities. This led to delays and increased stress for the family. Conversely, in another case, my client appointed a trusted friend who had strong financial acumen. The process went smoothly, and the beneficiaries were grateful for the thoughtful selection.

Those are insightful examples. What advice would you give to someone trying to decide who to appoint as executor or trustee?

Steve Bliss

Consider these factors: trustworthiness, organizational skills, financial literacy, and willingness to take on the responsibility. Have an open and honest conversation with potential candidates to ensure they understand the duties involved. Moreover, it’s advisable to name a backup executor in case your first choice is unable or unwilling to serve.
