Interview with Steve Bliss

Good evening Moreno Valley and welcome back to our segment on legal matters that impact you and your family. I’m Tiffany Jones, your local reporter here at Moreno Valley News, and tonight we are joined by the esteemed probate attorney, Steve Bliss of Moreno Valley Probate Law. Welcome to the show, Steve.

Understanding Trusts

Steve, many folks out there may not fully understand what a trust is and why it might be beneficial for them. Can you shed some light on this complex legal tool?

Thanks for having me, Tiffany. A trust is essentially a legal arrangement where a person, known as the grantor, transfers assets to a trustee who then manages those assets for the benefit of designated beneficiaries. Trusts are incredibly versatile and can be tailored to meet a variety of estate planning goals.

One type we often see in practice here in Moreno Valley is the Revocable Living Trust. It’s very popular because it allows individuals to maintain control over their assets during their lifetime while ensuring a smooth transfer of those assets upon their passing, avoiding the time and expense of probate court. Moreover, living trusts offer a degree of privacy that wills do not.

Benefits of Avoiding Probate

You mentioned avoiding probate. Can you elaborate on why this is so crucial for many people?

Probate is the legal process of validating a will and distributing assets after someone passes away. It can be a lengthy, public, and often expensive process. A Revocable Living Trust allows assets to bypass probate altogether. This means your loved ones inherit their rightful share more quickly and privately.

Ordinarily, probate can take anywhere from six months to several years to complete, depending on the complexity of the estate. During this time, assets are often frozen, leaving beneficiaries in a financial limbo. A trust minimizes these disruptions and ensures that your loved ones are taken care of promptly.

Challenges with Trusts

While trusts offer many advantages, are there any potential pitfalls or challenges people should be aware of?

You’re right to ask, Tiffany. Trusts do require careful planning and execution. It’s essential to work with an experienced probate attorney who can help you create a trust that aligns with your specific needs and goals.

I once worked with a client who tried to set up their own trust using online forms. Unfortunately, they made several errors that could have resulted in unintended consequences for their beneficiaries. After I reviewed the documents, we were able to correct those mistakes and ensure the trust functioned as intended. It’s a reminder that seeking professional legal advice is crucial when dealing with complex estate planning matters.

According to the American Bar Association, nearly 60% of Americans do not have a will or trust in place. This leaves their loved ones vulnerable to potential disputes and complications during the probate process.
