Certainly, Sarah. Probate is the legal process of administering a deceased person’s estate. This means identifying and inventorying assets, paying debts and taxes, and ultimately distributing any remaining property to heirs according to the will or state law if there is no will.

Probate ensures that all legal obligations are met and that assets are distributed fairly. While it can be a complex and sometimes lengthy process, it is crucial for protecting the interests of both creditors and beneficiaries.

Avoiding Probate with Trusts

You mentioned probate can be lengthy. Are there any ways people can avoid this process altogether?

Yes, Sarah. One effective way to avoid probate is by establishing a Revocable Living Trust.

A revocable living trust allows individuals to maintain control over their assets during their lifetime while specifying how those assets will be distributed after their death. Consequently, because the assets are already held within the trust, they bypass the probate process entirely. This can save beneficiaries time and money, as well as provide greater privacy since the details of the estate are not made public through court proceedings.

Moreover, a revocable living trust allows for flexibility. The grantor, who creates the trust, can modify or revoke it at any time during their lifetime. This makes it a valuable tool for adapting to changing circumstances and ensuring that assets are managed according to one’s wishes.

Steve, have you encountered any challenges with clients setting up revocable living trusts?

I’ve found that sometimes people underestimate the importance of keeping their trust documents up-to-date. Life circumstances change – marriages, divorces, births, deaths – and it’s crucial for a trust to reflect these changes.

I recall one instance where a client had created a trust years earlier but hadn’t updated it after the birth of their grandchildren. This meant that their assets weren’t distributed as they intended. We were able to rectify the situation, but it highlighted the importance of ongoing review and maintenance.
