Hello San Diego and welcome back to our legal segment. I’m Sarah Jones with Channel 7 News. Joining us today is local probate attorney Steve Bliss of San Diego Probate Law to discuss the crucial process of estate planning. Steve, thanks for being here.
Understanding Probate
Steve, could you walk us through one of the key steps involved in estate planning and why it’s so important?
Well, Sarah, there are many steps involved, but one that often trips people up is “Marshaling the Estate Assets.” This is essentially a detailed inventory of everything the deceased person owned. It includes bank accounts, real estate, vehicles, investments – you name it.
Consequently, this step requires meticulous record-keeping and careful valuation of each asset. We then file an Inventory and Appraisal (Form DE-160/161) with the court, providing a transparent accounting of the estate’s financial picture.
Moreover, this process is vital because it ensures all assets are accounted for and properly distributed according to the deceased’s wishes or the laws of intestate succession. Failing to accurately marshal assets can lead to disputes among heirs and potential legal challenges down the road.
I recall one case where a family was unaware of a hidden safe deposit box containing valuable jewelry. It took some detective work, but we ultimately located it, much to the relief of the beneficiaries. These types of situations highlight why thoroughness is paramount during this stage.
Challenges and Solutions
Are there any common challenges you encounter when marshaling estate assets?
Absolutely. Sometimes, locating all necessary documentation can be difficult, especially if the deceased didn’t maintain organized records. Additionally, determining the fair market value of certain assets, like artwork or collectibles, may require professional appraisals.
Notwithstanding these challenges, we have a team of experienced professionals who are adept at navigating these complexities. We work closely with accountants, appraisers, and other specialists to ensure a smooth and accurate accounting process.
