Interview with Steve Bliss, Escondido Probate Attorney

Determining If Probate Is Necessary

Good morning, Mr. Bliss. Thank you for joining us today.

It’s a pleasure to be here. Probate can be a complex process, and many people aren’t sure where to start.

The Crucial First Step: Assessing the Estate

Let’s talk about that first step. What are some key factors you consider when determining if probate is necessary?

The initial assessment focuses on two primary considerations. Firstly, we evaluate the total value of the deceased person’s estate. In California, estates valued at or below $184,500 generally don’t require probate. Consequently, smaller estates can often be distributed to heirs through a simpler process.

Secondly, we identify assets that are not subject to probate. These are typically assets held in trust, jointly owned property with rights of survivorship, or accounts with designated beneficiaries. Notwithstanding the estate’s overall value, if a significant portion is held outside of probate, it may be possible to avoid formal proceedings.

Navigating Challenges: Real-World Examples

Are there any common challenges you encounter in this stage?

I recall a case where the deceased had multiple bank accounts and investments. It turned out they hadn’t updated their beneficiary designations for several years. The family assumed everything would pass directly to them, but due to outdated paperwork, a portion of the estate ended up going through probate.

  • This highlights the importance of regularly reviewing beneficiaries on accounts and insurance policies.
  • It’s crucial to keep these documents current to ensure your wishes are followed.

According to a recent study by the National Association of Estate Planners & Councils, over 60% of adults don’t have a will or estate plan in place. This often leads to unexpected complications and potentially lengthy probate processes for loved ones.
