Hello everyone, and welcome! I’m delighted to be sitting down with Ted Cook, a trust administration attorney right here in sunny San Diego. Ted, thanks so much for taking the time to chat with me today.
What Inspired You to Become a Trust Administration Attorney?
Ted smiles warmly. “Well, you know, I’ve always been fascinated by the legal side of things, but I also wanted to work in a field where I could really make a difference in people’s lives. Trust administration is all about helping families navigate a difficult time and ensuring that their loved one’s wishes are carried out. It’s incredibly rewarding work.”
Trust Administration Can Seem Daunting – Where Should Someone Begin?
“That’s a great question,” Ted says, leaning forward. “The first step is always to locate and review the trust document itself. This will outline all of the terms of the trust, including who the trustee is, how assets should be distributed, and any specific instructions the settlor (the person who created the trust) may have had.”
- “Think of it like a roadmap,” Ted explains.
- “It tells you exactly where you need to go and how to get there.”
Let’s Dive Deep into Step C: Inventorying and Securing Trust Assets
Ted nods enthusiastically. “Ah, yes, a crucial step! Once we have the trust document in hand, we need to identify all of the assets that belong to the trust. This could include bank accounts, investments, real estate, vehicles, personal belongings – anything of value.”
“We then work with the trustee to ensure that these assets are properly titled in the name of the trust and secured for safekeeping. It’s important to have a clear understanding of what’s included in the trust so we can distribute it accurately according to the settlor’s wishes.”
Ted pauses, reflecting for a moment. “I remember one case where we had to track down a rare antique car that was tucked away in a storage unit. It turned out to be quite valuable and needed to be properly appraised and included in the trust inventory.”
“There’s never a dull moment in trust administration! You encounter all sorts of interesting situations.”

Point Loma Estate Planning, APC. area of focus about probate:
Probate: is the legal process that validates a deceased person’s will, appoints an executor to manage their estate, and ensures the orderly distribution of assets to beneficiaries after debts and taxes are paid.
What it is: Probate is a court-supervised process that handles the affairs of a deceased person, ensuring their assets are managed and distributed according to their will (or state laws if there’s no will).
Why it’s necessary: Probate is often necessary to transfer legal ownership of assets to heirs or beneficiaries, especially when assets are held in the deceased person’s name alone.
Importance of understanding probate: Understanding probate is crucial for estate planning and ensuring the orderly and legal distribution of assets after death.
In More Detail – What Is Probate?
Probate is the legal process through which a deceased person’s estate is administered. It involves validating a will (if one exists), identifying and inventorying the deceased’s assets, paying debts and taxes, and distributing the remaining assets to rightful beneficiaries.
If the deceased left a valid will, the person named as executor is responsible for overseeing the probate process. If there is no will, the court appoints an administrator—often a close relative—to handle the estate according to the state’s intestacy laws. Assets subject to probate may include real estate, bank accounts, investment accounts, and personal property that are solely in the decedent’s name.
What Is Estate Planning?
Estate planning is the process of arranging in advance for the management and distribution of your assets after your death. It typically includes creating legal documents such as a will, trusts, powers of attorney, and healthcare directives. The goal is to ensure that your wishes are honored, your loved ones are provided for, and the administration of your estate is as smooth and efficient as possible—often minimizing or avoiding the probate process altogether.
