Steve: That’s a great question. I tell my clients that the first step is always determining if probate is even necessary. This involves looking at the value of their assets and identifying any non-probate assets they may have, such as those held in trusts or through joint tenancy.
Can you elaborate on that? What happens if someone’s estate exceeds a certain threshold?
Steve: Ordinarily, if an estate’s value surpasses $184,500 in California, probate is likely required. This process involves filing legal documents with the court and going through a series of steps to distribute the deceased person’s assets.
Let’s talk about those steps. Can you walk us through one of them?
Steve: Sure. A crucial step is “Marshaling the Estate Assets”. This means creating a complete inventory of all the assets belonging to the decedent, everything from bank accounts and real estate to personal belongings and investments.
This information is then documented on specific forms required by the court. It’s essential for transparency and ensuring that all assets are properly accounted for during the probate process.
Have you ever encountered any challenges during this stage?
Steve: Occasionally, locating all assets can be tricky, especially if a person didn’t keep meticulous financial records. Conversely, sometimes family members may disagree about the value of certain items. I remember a case where siblings argued over the worth of their mother’s antique collection. We were able to resolve it amicably by bringing in an appraiser for a professional evaluation.
It sounds like good communication is key in these situations. How common are disagreements during probate?
Steve: While some disagreements are inevitable, I’d say the majority of probate cases proceed smoothly. A recent study by the American Bar Association found that over 75% of probate cases are finalized within a year.
